1. Without prejudice to the application of penalties laid down in the contract, candidates or tenderers and contractors who have made false declarations, have made substantial errors or committed irregularities or fraud, or have been found in serious breach of their contractual obligations may be excluded from all contracts and grants financed by the Union budget for a maximum of five years from the date on which the infringement is established as confirmed following a contradictory procedure with the candidate, tenderer or the contractor.

Onverminderd de toepassing van contractuele sancties kunnen gegadigden, inschrijvers of contractanten die valse verklaringen hebben afgelegd, substantiële fouten, onregelmatigheden of fraude hebben begaan, of ernstig in gebreke zijn gebleven wegens niet-nakoming van hun contractuele verplichtingen, worden uitgesloten van alle uit hoofde van de EU-begroting gefinancierde opdrachten en subsidies gedurende maximaal vijf jaar vanaf de vaststelling van de na een contradictoire dialoog met de gegadigde, inschrijver of contractant bevestigde overtreding.
