In any case, these restrictions to the fundamental right to data protection should comply with a strict proportionality test, i.e. should be limited — both in their substance and in their application in time — to what is necessary to pursue the public interest at stake, as confirmed by the case law of the Court of Justice, also in the area of restrictive measures.
Die beperkingen van het grondrecht op gegevensbescherming dienen in ieder geval een strenge evenredigheidstoets te doorstaan, met andere woorden, zij dienen, ook op het gebied van beperkende maatregelen, zowel inhoudelijk als in de tijd beperkt te zijn tot wat nodig is om het in het geding zijnd openbaar belang te dienen, zoals bevestigd door de jurisprudentie van het Hof van Justitie.
