Il diritto al silenzio e il diritto di non autoincriminarsi non dovrebbero impedire agli Stati membri di decidere che, per quanto riguarda le infrazioni minori, quali le infrazioni minori del codice della strada, lo svolgimento del procedimento, o di alcune sue fasi, possa avvenire per iscritto o senza un interrogatorio dell'indagato o imputato da parte delle autorità competenti in merito al reato in questione, purché ciò avvenga in conformità con il diritto a un equo processo.
The right to remain silent and the right not to incriminate oneself should not preclude Member States from deciding that, with regard to minor offences, such as minor road traffic offences, the conduct of the proceedings, or certain stages thereof, may take place in writing or without questioning of the suspect or accused person by the competent authorities in relation to the offence concerned, provided that this complies with the right to a fair trial.
