Infatti, in primo luogo, è vero che la relazione speciale al Parlamento europeo del Mediatore 1004/97/(PD)GG, del 18 ottobre 1999, disponibile sul sito Internet del Mediatore, contiene una raccomandazione alla Commissione nel senso che, a partire dal 1° luglio 2000 al più tardi, essa dovrebbe consentire l’accesso alle loro proprie prove corrette ai candidati a concorsi che ne facciano domanda e che, nel comunicato stampa 15/2000, del 31 luglio 2000, citato dalla ricorrente, disponibile sul sito Internet del Mediatore, si afferma che «[l]a Commissione ha accettato la raccomandazione del Mediatore che ha avuto effetto nel luglio 2000».

Tale conclusione non può essere rimessa in questione dagli argomenti della ricorrente relativi ad un ipotetico diritto di accesso dei candidati di un concorso alle prove scritte corrette, fondato su una raccomandazione del Mediatore alla Commissione, del 18 ottobre 1999, sull’accettazione di tale raccomandazione da parte della Commissione e su un’indagine del Mediatore, avviata nel 2005, la quale sarebbe terminata con una nuova raccomandazione alla Commissione relativa all’obbligo, per quest’ultima, di informare i candidati che ne facciano domanda sui criteri di valutazione.
