25. ritiene che la sentenza nella causa Shevill vada qualificata; ritiene pertanto che, per ridurre la presunta tendenza di talune giurisdizioni ad accettare una competenza territoriale quando esiste soltanto un debole legame con il paese in cui è stata avviata l'azione, dovrebbe essere aggiunto un considerando inteso a precisare che, in via di principio, le giurisdizioni del paese in questione dovrebbero accettare la competenza solo se vi è un legame sufficiente, sostanziale o significativo con detto paese; ritiene che ciò potrebbe contribuire a definire un migliore equilibrio tra gli interessi in gioco;

Believes that the rule in Shevill needs to be qualified; considers, therefore, that, in order to mitigate the alleged tendency of courts in certain jurisdictions to accept territorial jurisdiction where there is only a weak connection with the country in which the action is brought, a recital should be added to clarify that, in principle, the courts of that country should accept jurisdiction only where there is a sufficient, substantial or significant link with that country; considers that this would be helpful in striking a better balance between the interests at stake;
