La Corte ha anche concluso che l'uso dei rifiuti come combustibile in un forno per cemento costituisce un'operazione di recupero quando nella combustione si produce calore in eccesso che è poi utilizzato nel processo [40]; viceversa, ha deciso [41] che l'incenerimento in un inceneritore destinato espressamente ai rifiuti urbani ha come obiettivo principale lo smaltimento dei rifiuti, aggiungendo che, nei casi analizzati, la classificazione dell'operazione come operazione di smaltimento non muterebbe se il processo avesse come effetto secondario la produzione e l'uso di energia.
The Court also concluded that use of waste as a fuel in a cement kiln is recovery when excess heat is generated and this heat is used in the process [40]. In contrast, the Court decided [41] that incineration in a dedicated municipal waste incinerator has for primary objective to dispose of the waste.
