L’Oberlandesgericht Innsbruck ha sospeso il procedimento e sottoposto alla Corte di giustizia delle Comunità europee due questioni, per accertare, in primo luogo, se le signore Dodl e Oberhollenzer hanno perso la qualità di "lavoratore subordinato" ai sensi del regolamento n. 1408/71, in conseguenza della sospensione del loro rapporto di lavoro, durante la quale esse non erano tenute a versare contributi previdenziali, e, in secondo luogo, quale Stato membro è competente, in via prioritaria, a corrispondere la prestazione familiare in causa.
First, it asked whether Ms Dodl and Ms Oberhollenzer had lost the status of ‘employed persons’ within the meaning of Regulation No 1408/71 as a result of the suspension of their employment relationship, during which they were not required to pay social security contributions, and second, which Member State is primarily responsible for paying the family benefit in issue.
