In linea di principio, l’Autorità non concorda con le autorità norvegesi sul fatto che l’esistenza dello sgravio fiscale non costituisca un vantaggio, ai sensi dell’articolo 61, paragrafo 1, dell’accordo SEE, se l’esenzione dall’imposta in questione ha inciso sulla determinazione dello stato patrimoniale di apertura della Entra in un modo che, secondo tali autorità, ha neutralizzato il vantaggio costituito dall'esenzione fiscale.
As a matter of principle, the Authority disagrees with the Norwegian Authorities that the existence of this tax relief would not constitute an advantage in the sense of Article 61(1) of the EEA Agreement if the exemption from excise duty has influenced the settingup of the opening balance sheet of Entra in a way that, allegedly, has neutralised the advantage flowing from the tax exemption.
