B. considerando che, in base a un accordo tra i due genitori, nel febbraio 1995 il giudice di pace belga ha pronunciato una sentenza in base alla quale la custodia dei tre bambini è stata assegnata al padre, in Belgio, paese dove essi sono nati e cresciuti; che i bambini si sarebbero recati in Kenya dalla madre per le vacanze (sei settimane d'estate, due settimane a Natale e a Pasqua e/o una settimana in occasione delle vacanze scolastiche invernali),
B. whereas, on the basis of an agreement between the two parents, a ruling was handed down by the Belgian Justice of the Peace in February 1995; custody of the three children was given to the father, in Belgium, where they were born and grew up; the children would join their mother in Kenya for the holidays (6 weeks during the summer, 2 weeks at Christmas and Easter, and/or one week at the half terms),
