La Corte ha inoltre riconosciuto[88] che il minore deve poter crescere, ai fini di un armonioso sviluppo della propria personalità, nell'ambiente familiare[89], che gli Stati membri devono provvedere affinché il minore non venga separato dai genitori contro la loro volontà[90], e che qualsiasi richiesta effettuata da un minore o dai genitori al fine di fare ingresso in uno Stato membro o di lasciare il medesimo ai fini del ricongiungimento familiare dev'essere considerata dagli Stati membri, in uno spirito positivo, con umanità e diligenza[91].
The CJEU has also recognised[88] that children, for the full and harmonious development of their personality, should grow up in a family environment[89], that MSs are to ensure that a child shall not be separated from his or her parents against their will[90] and that applications by a child or his/her parents to enter or leave a MS for the purpose of family reunification are to be dealt with by the MSs in a positive, humane and expeditious manner[91].
